Outdoor furniture e-store terms
Owner Information:
The online store Livoutdoor.eu (hereinafter referred to as the Online Store) is owned by Liv Outdoor OÜ (registration code 14671264), located at Kõrtsi tee 7, Lehmja, Rae Parish, Harjumaa).
Validity of the Sales Agreement, Product, and Price Information:
- The terms of sale are valid when purchasing goods from the Online Store.
- Prices of the products sold in the Online Store are indicated next to the products. The price excludes a delivery fee.
- The delivery fee depends on the buyer's location and the delivery method. The delivery fee is displayed to the buyer when placing the order.
- Information about the goods is provided directly next to the product in the Online Store.
Placing an Order:
- To order a product, add the desired products to the shopping cart. Fill in the required fields and choose the appropriate delivery method for the products. The total fee will then be displayed, which can be paid via bank link or other payment solutions.
- The agreement comes into force from the moment the payable amount is received in the Online Store’s account.
- If the ordered goods cannot be delivered due to the product being out of stock or for any other reason, the buyer will be informed at the earliest opportunity and the paid amount (including delivery costs) will be refunded immediately but no later than within 3 days of sending the notice.
Delivery:
- Goods are shipped to the following countries: Estonia, Lithuania, Latvia.
- The shipping costs are borne by the buyer and the corresponding price information is displayed next to the shipping method.
- Domestic shipments generally reach the destination specified by the buyer within 3-7 business days from the entry into force of the sales agreement. Delivery outside of Estonia takes place within 5-7 calendar days.
- In exceptional cases, the right to deliver goods up to 45 calendar days is reserved.
Right of Withdrawal:
- After receiving the order, the buyer has the right to withdraw from the contract concluded in the Online Store within 14 days.
- The right of withdrawal does not apply if the buyer is a legal entity.
- To exercise the 14-day right of return, the ordered goods may not be used in any other way than is necessary to ascertain the nature, characteristics, and functioning of the goods in the same way as it is allowed to test the goods in a physical store.
- If the goods have been used for a purpose other than necessary to ascertain the nature, characteristics, and functioning of the goods, or if there are signs of use or wear, the Online Store has the right to reduce the refundable amount according to the decrease in the value of the goods.
- To return the goods, a free-form withdrawal application must be submitted and sent to the e-mail address info@livoutdoor.eu no later than within 14 days of receiving the goods.
- The costs of returning the goods are borne by the buyer unless the reason for the return is that the item to be returned does not correspond to the ordered item (e.g., wrong or defective item).
- The buyer must return the goods within 14 days after submitting the withdrawal application or provide proof that they have handed over the goods to the carrier within this period.
- Upon receipt of the returned goods, the Online Store will promptly refund the amount paid by the buyer under the contract, but no later than 14 days after receiving the withdrawal application.
- The Online Store may refuse to make refunds until the item subject to the contract has been returned or until the buyer provides proof that they have returned the item, whichever occurs first.
- If the buyer has explicitly chosen a delivery method other than the cheapest standard delivery method offered by the Online Store, the Online Store is not required to refund the cost that exceeds the cost of the standard delivery method.
- The Online Store has the right to withdraw from the sales transaction and demand the return of the goods from the buyer if the price of the goods in the Online Store was mistakenly marked significantly below the market price of the goods.
Right to File a Complaint:
- The Online Store is responsible for the non-compliance or defects of the goods sold to the buyer that already existed at the time of delivery and that become apparent within two years from the date of delivery to the buyer. During the first year from the date of delivery, it is presumed that the defect existed at the time of delivery. Refuting this presumption is the responsibility of the Online Store.
- The buyer has the right to contact the Online Store within two months of the defect occurring by sending an e-mail to info@livoutdoor.eu or calling +372 6 888 617.
- The Online Store is not responsible for defects that occurred after the goods were delivered to the buyer.
- If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund the buyer all fees incurred under the sales contract.
- The Online Store will respond to the consumer's complaint in writing or in a form that can be reproduced in writing within 15 days.
Direct Marketing and Processing of Personal Data:
- The Online Store uses the personal data entered by the buyer (including name, phone number, address, e-mail address, bank details) only for processing the order and sending the goods to the buyer.
- The Online Store forwards personal data to transport service companies to deliver the goods.
- The Online Store sends newsletters and offers to the buyer's e-mail address only if the buyer has expressed their wish to receive direct mail notifications by entering their e-mail address on the website and indicating their desire to receive direct mail notifications.
- The buyer can unsubscribe from offers and newsletters sent to their e-mail at any time by notifying us via e-mail or by following the instructions in the e-mail containing the offers.
Dispute Resolution:
- If the buyer has any complaints regarding the Online Store, they should be sent to the e-mail address info@livoutdoor.eu or by calling +372 6 888 617.
- If the buyer and the Online Store cannot resolve the dispute by agreement, the buyer can turn to the Consumer Disputes Committee. More detailed information can be found on the Consumer Protection and Technical Regulatory Authority website. The competence of the Consumer Disputes Committee is to resolve disputes arising from the contract concluded between the buyer and the Online Store. The examination of the buyer's complaint by the committee is free of charge.
